Article 1 — Legal Notice

The SongTrivia application (hereinafter "the Application") is published by:

Article 2 — Purpose

These Terms of Use (hereinafter "Terms") define the conditions for accessing and using the SongTrivia Application, available on iOS, Android, and the Web.

SongTrivia is a music quiz application that allows users to test their musical knowledge through various game modes, solo or multiplayer.

Any registration or use of the Application implies unreserved acceptance of these Terms. If you do not accept these conditions, you must not use the Application.

Article 3 — Access to the Application

3.1 The Application is freely accessible from the following platforms:

3.2 Access to certain features may require the creation of a user account and/or a paid subscription or in-app purchases.

3.3 The publisher reserves the right to suspend, limit, or interrupt access to all or part of the Application for maintenance, updates, or any other reason, without this giving rise to any compensation.

3.4 Using the Application requires a compatible device and an internet connection. Connection and equipment costs are borne exclusively by the user.

Article 4 — Registration and User Account

4.1 To access certain features, the user must create an account by providing the following information:

4.3 Any access to the Application using the user's credentials is deemed to have been performed by the user. In the event of loss, theft, or unauthorized use of credentials, the user must immediately notify the publisher at julien@anthm.fr.

4.4 The publisher reserves the right to suspend or delete any account in the event of a breach of these Terms, without notice or compensation.

Article 5 — Subscriptions and In-App Purchases

5.1 Subscriptions

The Application offers paid subscriptions providing access to premium features. The terms (duration, price, content) are specified in the Application at the time of subscription.

5.2 Free Trials

The Application may offer free trial periods before a paid subscription begins.

5.3 In-App Purchases

The Application offers in-app purchases for acquiring additional content or features (credits, game items, etc.).

5.4 Pricing

Prices are displayed in euros (EUR) or in the user's local currency, inclusive of all taxes. The publisher reserves the right to modify its prices at any time. In the event of a subscription price change, the user will be notified in advance and must accept the new price for the next renewal.

6.1 The Application displays advertisements provided by third-party advertising networks, including Playwire (https://www.playwire.com). These advertisements may be targeted based on user data, subject to the user's consent when required, and in compliance with applicable regulations and the Application's Privacy Policy.

6.2 The user may, depending on the available offer, subscribe to a premium plan to enjoy an ad-free or reduced-ad experience.

6.3 The publisher is not responsible for the content of advertisements displayed by third parties within the Application.

In the event of a breach of these rules, the publisher reserves the right to suspend or delete the user's account, temporarily or permanently, without notice or compensation.

Article 8 — Intellectual Property

8.1 All elements comprising the Application (design, code, text, graphics, images, sounds, databases, trademarks, logos, etc.) are the exclusive property of the publisher or its partners and are protected by French and international intellectual property laws.

8.2 Musical content used in quizzes (audio clips, song titles, artist names, album covers) is the property of their respective rights holders. Their use in the Application is made under the licenses and authorizations obtained by the publisher.

8.3 Any reproduction, representation, modification, publication, or adaptation, in whole or in part, of any element of the Application, by any means whatsoever, is prohibited without the prior written authorization of the publisher.

8.4 The Application is licensed, not sold, to the user. The publisher reserves all rights not expressly granted.

Article 9 — Right of Withdrawal

9.1 In accordance with Article L.221-28 of the French Consumer Code (Code de la consommation), the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a tangible medium, the performance of which has begun with the consumer's prior express consent and express waiver of the right of withdrawal.

9.2 By subscribing or making an in-app purchase, the user acknowledges that the provision of the service begins immediately and expressly waives their right of withdrawal.

Article 10 — Liability

10.1 The publisher endeavors to ensure the proper functioning of the Application. However, the Application is provided "as is" without any warranty of any kind, express or implied.

The processing of users' personal data is described in the Application's Privacy Policy, accessible at https://www.songtrivia2.io/privacy, which forms an integral part of these Terms.

Article 12 — Modification of the Terms

The publisher reserves the right to modify these Terms at any time. Users will be notified of changes by notification within the Application or by email. Continued use of the Application after notification constitutes acceptance of the new Terms.

In the event of a substantial modification, the user will have a reasonable period to accept or refuse the new conditions. In the event of refusal, the user may terminate their account.

Article 13 — Termination

13.1 The user may delete their account at any time from the Application's settings or by sending a request to julien@anthm.fr.

13.2 Upon account deletion, any active subscription must be cancelled separately by the user through the relevant platform (App Store, Google Play, or website). Account deletion does not automatically cancel an active subscription.

13.3 The publisher may terminate or suspend a user's account in the event of a breach of these Terms, with immediate effect and without notice.

13.4 Termination results in the deletion of the account and associated data, subject to legal data retention obligations.

Article 14 — Governing Law and Disputes

14.1 These Terms are governed by French law.

14.2 In the event of a dispute, the user may use a consumer mediator free of charge under the conditions provided for in Articles L.611-1 et seq. of the French Consumer Code (Code de la consommation).

14.3 Failing an amicable resolution, any dispute shall be brought before the competent courts in accordance with ordinary rules of law.

Article 15 — Miscellaneous Provisions

15.1 If any clause of these Terms is declared null or unenforceable, the remaining clauses shall retain their full force and effect.

15.2 The publisher's failure to exercise a right or to require compliance with an obligation under these Terms shall not constitute a waiver of that right or obligation.

15.3 These Terms constitute the entire agreement between the user and the publisher regarding the use of the Application.

15.4 In the case of a download from the Apple App Store, these Terms constitute an agreement between the user and the publisher (and not with Apple). Apple is not responsible for the Application or its content. In the case of a download from Google Play, Google Play's terms apply in addition.
